New regulations on cash payment in border trade activities from December 1st, 2024

On October 4th, 2024, the Government issued Decree No. 122/2024/ND-CP amending and supplementing several articles of Decree No. 14/2018/ND-CP dated January 23rd, 2018 of the Government detailing regulations on border trade activities (“Decree No. 122/2024/ND-CP”). Decree No. 122/2024/ND-CP has several new points as follows:

– Amendment Clause 2, Article 4 of Decree No. 14/2018/ND-CP regarding payment methods in border trade activities. Decree No. 122/2024/NĐ-CP retains the three payment methods stipulated in Decree No. 14/2018/ND-CP, including payment via banks, offset payment between export goods and services and import goods and services (the difference paid via banks), and cash payment. However, according to the new regulations, the cash payment method will only apply to the purchase and exchange of goods by border residents.

– Addition Article 4a to Article 4 of Decree No. 14/2018/ND-CP regulating standards for goods in border trade activities:

Goods in the purchase and exchange of goods across borders by traders and border residents must fully meet the standards, quality, traceability regulations, and other conditions as prescribed by the import country’s laws.

Decree No. 122/2024/ND-CP takes effect from December 1st, 2024.
