New regulations on administrative sanctions relating to labour

On March 01, 2020, the Government issued Decree No. 28/2020/ND-CP on administrative sanctions against regulations on employment, social insurance, Vietnamese guest workers, replacing Decree No. 95/2013/ND-CP and Decree No. 88/2015/ND-CP.

Decree No. 28/2020/ND-CP contains some penalty adjustments. In addition, this Decree also supplements a number of notable regulations on administrative sanctions and social insurance as follows:

  • A fine shall be imposed from 10,000,000 to 15,000,000 VND when an employer applies multiple labor disciplines on one labor discipline violation (Point d, Clause 3, Article 18);
  • A fine shall be imposed from 10,000,000 to 15,000,000 VND when an employer requires an under 15 year old employee to work overtime or on night shift (Point c, Clause 2, Article 28);

 

  • A fine shall be imposed from 10,000,000 to 15,000,000 VND when an employer does not pay social insurance and health insurance, in accordance with current regulations, for the live -I housekeeper (Point b, Clause 2, Article 29);
  • A fine shall be imposed from 500,000 to 1,000,000 VND when an employer does not publicize annually the listing of contribution to social insurance for employees which provided by social insurance agencies (Point a, Clause 2, Article 38);

This Decree takes effects from April 15,2020.
