On May 13th 2019, the Government issued the Decree No 40/2019/ND-CP amending the Decrees guiding the Law on Environmental Protection. The decree regulates the conditions for importing scrap as production materials as follows:
Only organizations and individuals with production facilities using scraps are allowed to import scrap as raw materials for production and have to meet the following requirements:
– Meeting the requirements and responsibilities for environmental protection;- Having environmental impact assessment reports approved by the Ministry of Natural Resources and Environment, including the contents of using imported scrap as production materials;
– Being granted a certificate of completion of environmental protection works or hazardous waste treatment permits;
– Having a certificate of eligibility for environmental protection in importing scrap.
Imported scrap is only allowed to be discharged into the port when:
– Organizations and individuals receiving goods on the manifest (E-Manifest) have a certificate of environmental eligibility in the import of scraps in effect and a volume of imported scrap;
– Organizations and individuals receiving goods on the E-Manifest have a written confirmation of the deposit to ensure imported scrap for scrap recorded on the E-Manifest.
This Decree takes effect from July 1st, 2019.
