Specifying regulations on the retirement age of the laborers

On November 18th, 2020, the Government issued Decree No. 135/2020/ND-CP on specifying Article 169 of the Labour Code on the retirement age.

Whereby, from January 1st, 2021, the retirement age of the laborers working in normal conditions shall be determined as follows:

  • For male laborers when reaching full 60 years and 3 months of age, and after that, for each following years, it will increase by 03 more months until reaching 62 years of age in 2028.
  • For female laborers when reaching full 55 years and 4 months of age, and after that, for each following years, it will increase by 03 more months until reaching 60 years of age in 2035.

Besides that, laborers who are entitled in the following cases may retire at an earlier age but for no more than 05 years of age to the time of their retirement, unless there are other legal regulations:

  • Having 15 years or more of working in heavy, hazardous, or dangerous jobs or extremely heavy, hazardous or dangerous jobs which are on the list issued by the Ministry of Labor, War Invalids and Social Affairs.
  • Having 15 years or more of working in severely disadvantaged areas, including the working period in areas with a region-based allowance coefficient of 0.7 or higher before January 1st, 2021 (severely disadvantaged areas). Laborers suffering a working capacity decrease of 61% or more.
  • Having 15 years or more in a total of working period in heavy, hazardous, or dangerous jobs or extremely heavy, hazardous, or dangerous jobs and in severely disadvantaged areas.

Decree No. 135/2020/ND-CP takes effect from January 1st, 2021.
