On October 10th, 2024, the Government issued Decree No. 128/2024/ND-CP amending and supplementing several articles of Decree No. 81/2018/ND-CP on trade promotion activities. Accordingly, the Decree has a number of notable new points as follows:
– Amendments and supplements to the regulations on cases exempted from the administrative procedure of notifying the implementation of promotions. Specifically, when enterprises conducting the following forms of promotions, will not be required to notify the competent state authorities (Point b, Clause 3, Article 1 of Decree No. 128/2024/ND-CP amending Clause 2, Article 17 of Decree No. 81/2018/ND-CP):
+ Organizing customers to participate in cultural, artistic, entertainment programs, and other events for promotional purposes.
+ Providing sample products or providing services for customers to try without paying.
+ Giving away goods or providing services without paying.
+ Selling goods or providing services at prices lower than their previous selling prices and service provision, applied during the announced promotion period (promotions in the form of discounts).
+ Selling goods or providing services accompanied by vouchers or service coupons.
– Amendments to several regulations on the announcement of results, awarding prizes, and reporting results of promotional programs (Point b, Clause 7, Article 1 of Decree No. 128/2024/ND-CP amending Clause 2, Article 21 of Decree No. 81/2018/ND-CP):
+ Enterprises conducting promotions in the form of selling goods or providing services accompanied by contest entry forms for customers to choose award givers according to the announced rules and prizes (or other equivalent forms of organizing contents and awarding prizes) will not be required to submit a report on the results of the promotion to the competent state authorities.
+ The deadline for remitting 50% of the announced value of the prize without a winner is adjusted to 45 working days from the date of receipt of the payment and collection decision from the regulatory authority (previously 15 days).
Decree No. 128/2024/ND-CP takes effect from December 01st, 2024.
