On June 24th, 2019, the Government promulgated the Decree No 55/2019/ND-CP on legal supporting for small and medium enterprises. It is implemented as follows:
1. Based on resources and supporting programs, the agencies and organizations that support legal for small and medium enterprises decide to support them in the following order of priority:
a) Women-owned small and medium-sized enterprises, enterprises employing more female workers than male workers shall meet the conditions for prior support;
b) Small and medium enterprises using from 30% of the disabled employees on the total number of workers as stipulated by the Law on Persons with Disabilities;
c) Small and medium-sized enterprises that submit applications meeting the conditions of prior support shall be supported in advance.
2. The specific support level as follows:
a) Microenterprises shall be supported 100% of legal consultancy expenses according to legal consulting agreements between legal consultants and enterprises, but not exceeding VND 3 million a year;
b) A small enterprise is entitled to a maximum of 30% of legal consultancy expenses according to legal consulting agreements between legal consultants and enterprises, but not exceeding VND 5 million a year;
c) Medium enterprises shall be supported with a maximum of 10% of legal consultancy expenses according to legal consulting agreements between legal consultants and enterprises, but not exceeding VND 10 million a year;
Criteria for determining small and medium enterprises are guided in Article 6, Decree 39/2018 / ND-CP.
This Decree takes effect from August 16, 2019 and replaces the Government’s Decree No. 66/2008 / ND-CP of May 28th, 2008 on legal support for enterprises.
