On December 12th, 2021, the Government issued Decree No. 112/2021/ND-CP prescribing some articles and law enforcement measures on Vietnamese working abroad in the form of labor contracts, there are some notable contents as follows:
- Supplementing conditions for the issuance of License for organizing Vietnamese to work abroad in the form of labor contracts
+ Conducting specification and categorization for mandatory specialized employees when implementing services of providers bringing workers to work in Taiwan (China) as regulated in Clause 1 Article 12 and in Japan as regulated in Clause 1 Article 15, details are as follows:
– Having at least 01 professional staff engaged in searching and developing the foreign labor marketing with qualified foreign language ability;
– Having at least 01 professional staff performing labor-management activities with qualified foreign language ability and with at least 01 years of experience in organizing Vietnamese workers to work in the receiving country;
– Having at least 01 professional staff carrying out job-oriented education activities with at least 01 years of experience in organizing Vietnamese workers to work in the receiving country.
- Increasing the margin deposit of organizing work abroad service providers
+ The margin deposit raised from 1.000.000.000 VND to 2.000.000.000 VND at a bank, foreign bank branch legally established and operating in Vietnam as stipulated in Clause 1 Article 23 Decree No. 112/2021/ND-CP.
+ Besides that, regarding service providers authorizing their branches to carry out organizing Vietnamese to work abroad in the form of labor contracts must add a margin deposit of 500.000.000 VND for each authorized branch.
This Decree takes effect from January 1st, 2022, and replaces Decree No. 38/2020/ND-CP dated April 3rd, 2020.
