On February 22, 2023, the Bac Ninh Tax Department issued Official Letter 447/CTBNI-TTHT, according to which:
In case the company is operating, has transferred in-use machinery and equipment of the project that is not entitled to CIT incentives for operations in the area entitled to CIT incentives, the income generated from these assets are not entitled to CIT incentives.
In case an operating company invests in upgrading, replacing or renovating technology of an operating project in an area eligible for tax incentives but does not meet one of the three criteria for an expansion investment project, tax incentives will be applied to the project in operation for the remaining time.
