On March 15th, 2023, the Business Registration Office – Hanoi Department of Planning and Investment issued Official Letter No. 180/CV-DKKKD on receiving the enterprise registration dossier for updating information of the legal representative’s chipped Citizen identity cards renewal on the Enterprise registration content, thereby:
The Business Registration Office has received feedback from some companies on receiving a notification (viaemail) from the Tax Agency requesting to change their enterprise registration before March 31st, 2023 which engages in the procedure for updating information of the legal representative’s chipped Citizen identity cards renewal on the Enterprise registration content.
After directly discussing with the Tax Agency, it was confirmed that the Tax Agency did not send any notifications, did not receive and process the dossier as well not collect any service fees to change the chipped Citizen identity cards for the legal representative on Enterprise Registration Certificate. Therefore, organizations and individuals that make the impersonation of the Tax Agency to provide services and collect payment shall be considered illegal acts.
The change of information on the Enterprise Registration Certificate must be conducted when there are any changes in the individual legal documents of the legal representative, enterprises must register with the Business Registration Authority within 10 days from the date of the change incurred.
Thus, in case the legal representative registered on the Enterprise Registration Certificate who does not have chipped Citizen identity cards or already had but their old People’s identity card/Citizen ID is not expired yet, the update can be implemented on the next adjustment which is suitable to avoid the increasing of unnecessary administrative procedures for the Business registration agency and troublesome procedures for the enterprise.
