On September 30th, 2022, the State Bank issued Circular No. 12/2022/TT-NHNN guidance on foreign exchange management for abroad loans and repayment of enterprises, which has the following notable contents:
Reporting regime for borrowers:
On a monthly basis, no later than the 5th day of the following month in the reporting period, the borrower must report online on the performance of short, medium and long-term loans at the Website for foreign loans and payment of foreign debts without government guarantee. In case the Website encounters a technical error and the report can not be sent, the borrower shall send a written report according to the form in Appendix 05 issued with this Circular.
This Circular takes effect from November 15th, 2022.
