On March 23, 2022, the National Assembly Standing Committee approved a resolution on overtime working hours in a month and in a year of employees.
Regarding the resolution, for the number of overtime working hours in a year, if the employer wishes and gets the employee’s consent, the employer will be able to use the employees to work overtime for more than 200 hours but not exceed 300 hours in a year.
Regarding the number of overtime working hours in a month, in case the employer is allowed to use the employee to work overtime for up to 300 hours in a year, with the employer’s needs and having consent from the employee, the employer may use the employee to work overtime for over 40 hours but less than 60 hours in 1 month.
Not applicable cases: Employees from full 15 years olds to under 18 years olds; employees with work capacity reduction of at least 51%, serious or very serious disabilities; Employees who involve heavy, hazardous or dangerous occupations or jobs or highly heavy, toxic or dangerous jobs; Female employees are pregnant from the 7th month or from the 6th month if working in highland, remote, border or island areas; Female employees who are raising children under 12 months old.
The resolution takes effect from April 1st, 2022; regulations on overtime working hours in a year take effect from January 1st, 2022.
