The Ministry of Labour, Invalids, and Social Affairs issued Decision No. 526/QD-LĐTBX on May 6th, 2021 published new promulgated, amended, and supplemented administration procedures related to the employment field within the state management scope of the Ministry of Labor, War Invalids and Social Affairs. Thereby, the Work permit renewal procedure for foreign employees working in Vietnam shall be detailed as follows:
Requirements and conditions for administrative procedures implementation:
Foreign workers with issued work permit must meet one of the following conditions:
- The remaining validity period of the work permit is at least 5 days but not exceeding 45 days.
- The competent authority grants an acceptance of demand for foreign workers.
- A document supporting that the foreign worker will continue in employment with the employer as specified in the concerned work permit is available.
Application for renewal of a work permit includes:
- An application form for renewal of work permit made according to Form No. 11/PLI Appendix I issued together with Decree No.152/2020/ND-CP.
- 02 color photos (4cm x 6cm size, white background, front view, bare head, no color glasses), taken within 6 months before the submission date of application.
- The granted valid work permit.
- An acceptance of demand for foreign workers, unless it is not required.
- A valid certified true copy of passport as per the law.
- A health certificate or a fitness to work certificate issued by a foreign or Vietnamese competent health facility issued within 12 months before the submission date of the application or the certificate as specified in regulations of the Minister of Health.
- Any document support that the foreign worker will continue in employment with the employer as specified in the issued work permit.
Specified requirement for this document is guided in this Decision.
- Any document mentioned in points 3, 4, 6, and 7 hereof is 1 original or certified true copy; if a document is issued by a foreign country, it must be consularly legalized, translated into Vietnamese, and certified, unless it is exempt from consular legalization under an international treaty to which the Socialist Republic of Vietnam and the concerned foreign country are signatories or under the principle of reciprocity or as per the law.
Processing period: Within 5 working days after receiving the valid dossiers
Besides that, this Decision amend and supplement some administration procedures such as:
- Report on demand, changing foreign workers need;
- Issuance of work permits for foreign employees working in Vietnam;
- Work permit renewal for foreign employees working in Vietnam;
- Certifications of exemption from work permit;
Request for the recruitment of Vietnamese workers to the job positions expected for foreign workers.
