Interlinkage of the declaration on employment, issuance of social insurance code, invoices registration during enterprise establishment procedures

From October 15th ,2020, Decree No. 122/2020/ND-CP on cooperation, interlinkage between registration of enterprises, branches, representative offices establishment and declaration on employment, issuance of social insurance code, invoices registration shall take effect. According to this Decree, there will be cooperation and information exchange between the state agencies through the method of digital data connecting, exchanging between information technology systems.

 

  • Business Registration Offices will be in charge of handling dossiers submission and return the result of the registration of enterprises, branches, representative offices establishment and declaration on employment, issuance of social insurance code, invoices registration, and then share the above information with the following agency:
  • Social insurance agencies on the information of the Enterprise Registration Certificate, Certificate of Branch/Representative office Registration and the total estimated number of the employee, business lines, social insurance contribution method of the enterprise, branch, representative office.
  • Labor Invalids and Social Affairs Office or Department of Labor Invalids and Social Affairs on the information of name, tax code, address, the legal representative of the enterprise, head of the branch, representative office, main business line, and the total estimated number of the employee of the enterprise, branch, representative office.
  • Tax agencies on the registration of enterprises, branches, representative offices establishment, and their invoices registration.

The state labor agencies, social insurance agencies, tax agencies shall not request enterprises, branches, representative offices to provide any copy of their Enterprise Registration Certificate, Certificate of Branch/Representative office Registration, other information that has been shared from Business Registration Offices, except for their name, enterprise, branch, representative office code whenever they carry out on related administrative procedures. Concurrently, enterprise, branch, representative office code will also be used as social insurance code.

Furthermore, This Decree also attaches the Application form for Enterprise Registration, and Application form for Registration of branches, representative offices and Business Locations.

This Decree shall take effect from October 15th, 2020.
