The unemployment insurance contribution is one of the conditions for the employee to enjoy the unemployment allowance. On May 29th, 2020, the Government issued Decree No. 61/2020/ND-CP amending and supplementing a number of articles under Decree No. 28/2015/ND-CP detailing the implementation of a number of articles on the unemployment insurance of the Law on Employment. Whereby, the Decree amended the provisions on cases that are determined to be contributing to the unemployment insurance as follows:
- The employee who has already paid the unemployment insurance premiums for the month that the labor contract or the employment contract was terminated and is certified by the social insurance agency on the social insurance book.
- The employee who has already paid the unemployment insurance premiums for the preceding month before the month that the labor contract or the employment contract was terminated and is certified by the social insurance agency on the social insurance book.
- In the preceding month of termination of the labor contract, the employment contract or in the month that the labor contract, the employment contract was terminated, the employee takes maternity or sick leave from 14 working days or more , without receiving monthly salary and this event was confirmed by the social insurance agency on the social insurance book.
- In the preceding month of termination of the labor contract, the employment contract or in the month that the labor contract, the employment contract was terminated, the employee neither works nor receives monthly salary from 14 working days or more at his/her unit and such event was confirmed by the social insurance agency on the social insurance book.
- In the preceding month of termination of the labor contract, the employment contract or in the month that the labor contract, the employment contract was terminated, the employee temporary stopped implementing the labor contract or employment contract from over 14 working days at his/her unit and such event was confirmed by the social insurance agency on the social insurance book.
The Decree No. 61/2020/ND-CP takes effect on July 15th ,2020.
