The Ministry of Labor, War Invalids and Social Affairs has just issued Decision No.1904/QD-LDTBXH regarding new administrative procedures, amendments and supplements to the field of social insurance under the scope of management functions of Ministry.
The decision stipulates the procedures for enjoying maternity regimes for female workers who are foreigner working in Vietnam and shall be eligible for maternity benefits when giving birth as follows:
Step 1: The employee submits the application for maternity benefits to the employer but no longer than 45 days from the date of backing to work. If the employee quits his/her job before giving birth, he /she shall submit a dossier and social insurance book directly to the social insurance agency.
Step 2: Within 10 days from the date of receiving documents from the employee, the employer is responsible for filing a pregnancy record under this regulation and submitting it to the social insurance agency.
Step 3:
+ Within 10 days from the date of receiving dossier as prescribed from the employer, the social insurance agency must solve and pay for the employee;
+ Within 05 working days from the date of receiving dossier as prescribed by the employee before giving birth, the social insurance agency must settle and pay for the employee.
+ In case the social insurance agency does not resolve it, they must reply by writing and clearly show the reason.
